From an order denying his motion for a new trial on the issue of damages only or, in the alternative, for a new trial on all issues, plaintiff appealed, notwithstanding defendants consent to an increase of the verdict to $1,000, conditioned upon the granting of a new trial to plaintiff on the issue of damages if defendant should refuse to consent to such increase.
